The Canadian government recognizes that "tied" or closed work permits make workers vulnerable. The Open Work Permit for Vulnerable Workers (OWP-V) allows you to legally leave an abusive employer and work for almost anyone else in Canada without leaving the country.
What Counts as Abuse?
IRCC defines abuse broadly. You may qualify if your employer is doing any of the following:
- Financial: Charging you illegal recruitment fees or withholding your pay.
- Psychological: Yelling, threats of deportation, or controlling your movements.
- Physical/Sexual: Any unwanted touching or unsafe, unsanitary living conditions provided by the employer.
- Coercion: Taking or holding your passport.
How to Secure Your Exit
- Gather Evidence Quietly: Use WORKWARS to log dates of unpaid overtime, threats, or take photos of unsafe housing conditions.
- Apply Online: You can apply for the OWP-V online. It is completely free, and IRCC processes these applications urgently.
- Family Protection: If you are approved, your family members in Canada may also be eligible for open work permits.
"Your employer will NOT be notified when you apply for the OWP-V. Service Canada keeps your application strictly confidential to protect you from retaliation."
